Terms of Service

1. The agreement

These Terms of Service (the “Terms”) form an agreement between you (“you”, “your”, or “Customer”) and Brynko Technologies (“we”, “us”, “our”), covering your use of brynko devOps Agent: the desktop application, this website, the customer portal, and the hosted services they connect to (together, the “Service”).

By creating an account, installing the application, or using the Service, you accept these Terms. If you are accepting on behalf of a company or other organisation, you confirm you are authorised to bind it, and “you” means that organisation.

2. Eligibility and accounts

• You must be at least 18 years old and able to enter a binding contract.
• You are responsible for the accuracy of the details on your account, and for keeping your credentials secure. Activity under your account is treated as yours.
• You may sign in with an email address and password, or with a Google account. Where you use Google, your access depends on that Google account remaining available to you.
• Tell us promptly at [email protected] if you believe your account has been accessed without your permission.

3. What the service does

brynko devOps Agent is a desktop application that connects to servers and systems you already control, using access credentials you supply. It gathers the state of those systems using read-only checks, and can carry out changes you approve, for example restarting a container, editing a configuration file, running one of your existing scripts, or installing software.

To answer your questions, the application sends relevant context, including the output of commands it has run on your systems, to AI model providers. Which providers, and what is and is not sent, is described in our Privacy Policy.

The Service depends on those AI model providers. If a provider is unavailable, degraded, or changes its terms, parts of the Service may be affected.

4. Your systems and your approvals

This is the most important section of these Terms. Please read it.

• You supply the access. You are responsible for the credentials you configure, for the level of permission the connecting user holds on each server, and for the restricted paths and elevated-access settings you choose. We recommend a dedicated account with the narrowest permissions that let it do the work you want.
• You approve every change. The application is designed to show you the exact command it intends to run, or a diff of the change it intends to make, and to wait for your explicit approval. When you approve an action, you are instructing it to run on your system.
• Consequences of approved actions are yours. We are not responsible for the outcome of an action you approved, including data loss, downtime, or configuration changes, whether or not the outcome was what you expected.
• Back up your systems. Some actions are made reversible: file edits are snapshotted, and a directory is archived before deletion. These are conveniences, not a backup system, and they are stored on the same machine as the data they protect. Maintain your own backups.
• Suitability is your judgement. You decide whether to use the Service on production systems, and you accept the risk of doing so.

You confirm you are authorised to grant access to every system you connect, and that doing so does not breach any agreement or policy binding you.

5. Credits and payment

• The Service is prepaid and usage-based. There is no subscription, no per-seat charge, and no per-server charge. You buy credits, and usage draws them down.
• New accounts receive 300 free credits. Free credits carry no cash value, are not refundable, and may be varied or withdrawn for future signups at any time.
• Credits are consumed as you use the Service. Consumption depends on the work requested and the AI models used, so the same request will not always cost the same. Estimates on this website are illustrative, not a quotation.
• Purchased credits do not expire.
• Prices are stated on the Pricing page and may change. A change does not affect credits you have already bought.
• Unless stated otherwise, prices exclude taxes. You are responsible for any tax arising on your purchase other than tax on our income.
• Payments are handled by a third-party payment processor. We do not receive or store your full card details.
• Refunds are governed by our Refund & Cancellation Policy.
• If your balance reaches zero, requests that require credits will stop working until you top up. Your data and configuration are not deleted because of a zero balance.

6. Acceptable use

You must not use the Service to:

• access, scan or alter any system you are not authorised to access;
• break any law, or infringe anyone's rights;
• build or distribute malware, or carry out an attack on any network or system;
• resell, sublicense, or provide the Service to a third party as your own product, unless we have agreed that in writing;
• reverse engineer, decompile or attempt to derive the source of the Service, except where that right cannot be excluded by law;
• evade credit metering, rate limits, or any technical restriction; or
• create accounts automatically or in bulk to obtain free credits repeatedly.

Because an agent with server access can cause real harm if misused, we treat breaches of this section seriously and may suspend an account immediately while we investigate.

7. Availability and changes

We aim to keep the Service available, but we do not promise uninterrupted or error-free operation and the Service is provided without a service level agreement unless we have signed one with you separately. We may add, change or remove features. Where a change materially reduces the Service, we will make reasonable effort to tell you in advance.

The desktop application may update itself so that it stays compatible with our services.

8. Intellectual property

We own the Service and everything in it, including the application, this website, and our documentation. We grant you a non-exclusive, non-transferable, revocable right to use the Service while these Terms are in force and your account is in good standing.

You keep all rights in your own material: your code, configuration, scripts, data and systems. You also keep the rights to scripts and configuration the Service drafts for you at your request; you are responsible for reviewing them before use.

You may send us feedback, and if you do we may use it without obligation to you.

9. Confidentiality and data

How we handle personal data and the content of your sessions is set out in our Privacy Policy, which forms part of these Terms. In summary: conversation content is sent to AI providers to produce a response, our servers record usage metering (how many tokens, how many credits, which model) rather than the content of your conversations, and your conversation history is stored locally on your own machine.

The Service attempts to redact secrets before content leaves your machine, and never transmits private key material. Redaction is largely pattern-based and cannot be guaranteed to catch every secret in every format. You remain responsible for what exists on the systems you connect, and we recommend using the restricted-path settings for anything that must never be read.

10. Disclaimers

To the fullest extent the law allows, the Service is provided “as is” and “as available”, and we disclaim all warranties, whether express, implied or statutory, including any warranty of merchantability, fitness for a particular purpose, and non-infringement.

In particular, we do not warrant that output produced with the help of AI models is accurate, complete or suitable for your purpose. AI models can be wrong, including confidently wrong. The Service is designed to ground its answers in what your systems actually report and to require your approval before changing anything, precisely because the model's judgement should not be the last word. Review what it proposes before you approve it.

11. Limitation of liability

To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for loss of profit, revenue, goodwill, or anticipated savings.

To the fullest extent the law allows, our total aggregate liability arising out of or relating to the Service and these Terms is limited to the amount you paid us in the three months immediately before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, for fraudulent misrepresentation, or for death or personal injury caused by negligence.

12. Indemnity

You will indemnify and hold us harmless against claims, losses and reasonable costs arising from your use of the Service in breach of these Terms, from your use of it on systems you were not authorised to access, or from actions you approved.

13. Suspension and termination

• You may stop using the Service and close your account at any time by contacting us.
• We may suspend or terminate an account that breaches these Terms, that is being used unlawfully, or where suspension is necessary to protect the Service or other customers. Where circumstances allow, we will tell you why.
• On termination, your right to use the Service ends. Unused credits are handled under the Refund & Cancellation Policy; credits are not refunded where the account was terminated for breach of these Terms.
• Sections that by their nature should survive termination will do so, including sections 8 to 12.

14. Governing law

These Terms are governed by the laws of India , and the courts of Saharanpur, Uttar Pradesh have exclusive jurisdiction over any dispute, except that either party may seek injunctive relief in any competent court.

15. Changes to these terms

We may update these Terms. The current version is always at https://cloudagent.brynko.in/terms with the date it took effect. Where a change is material, we will make reasonable effort to notify you (by email or in the application) before it takes effect. Continuing to use the Service after a change means you accept the updated Terms.
